With reference to his Note Verbale of yester-
day's date and to the reply received from the
Imperial Foreign Office verbally to-day, His
Britannic Majesty's Chargé d'Affaires has the
honour to state that he had entertained the hope
that the arrest of the fugitive offender Ernest
Horwitz might be effected by order of the Minister
of Justice on the ground of Internationel Comity,
notwithstanding that no Extradition Treaty exists be-
tween Great Britain and Japan. Should, however, His
Excellency the Imperial Minister for Foreign Affairs
be unable to move the Department concerned to effect
the arrest as requested His Britannic Majesty's
Chargé d'Affaires earnestly begs that His Excellency
will be so good as to endeavour that instructions may
be issued to the Police to keep a watch upon the mar
in question should he arrive in Yokohama by the
Steamship "Peru" to-morrow as anticipated, in order
